ChaletsAuQuebec.com (hereinafter the “Platform”) offers services for the distribution and visibility of cottage rental listings and cottages for sale.
1. Purpose of the Service
The Platform acts exclusively as an advertising and technological intermediary.
It does not participate in any financial transactions between property owners and guests
or potential buyers.
2. Definitions
Owner: for the purposes of these terms, the term “Owner” refers to any individual or legal entity
that publishes, manages, or lists a property on the Platform, including property managers,
management companies, agents, or any other person acting on behalf of the legal property owner.
Any person using the Platform in such capacity is deemed to have the authority
to act and bind the property owner with respect to the listed property.
3. Types of Subscriptions
3.1 Subscription – Cottage Rental
The rental subscription allows for the distribution and promotion of a short-term and long-term rental listing.
It does not guarantee any minimum number of bookings, revenue, or inquiries.
3.2 Subscription – Cottage for Sale
The sale subscription allows for the distribution and promotion of a listing intended for the sale of a cottage or land.
- No commission is charged by the Platform on the sale;
- The Platform does not provide any guarantee of sale;
- The subscription may be cancelled at any time by the owner, without any right to a refund.
4. Service Deemed Rendered and No Refund Policy
All subscriptions are deemed fully rendered once the listing is published
and access to the associated features is granted.
No refund, in whole or in part, shall be granted, including in the event of voluntary cancellation, removal of the listing, absence of a sale or rental, or if the property is sold, rented, or transferred to a third party, whether the transaction occurs through the Platform or by any other means.
5. Acceptance of the Terms
By proceeding with payment, the owner acknowledges having read, understood, and accepted
all of these terms and conditions, which constitute a binding agreement between the parties.
6. Owner Responsibilities
The owner is solely and fully responsible for the accuracy, completeness, and ongoing updating of
all information, descriptions, prices, conditions, availability, and images displayed in the listing.
The owner is responsible for ensuring that the property and its activities comply with all applicable
laws and regulations, including municipal, provincial, and federal requirements related to short-term
rentals or property sales.
The owner must obtain, maintain in force, and display all permits, licences, registrations, or
identification numbers required by the competent authorities.
Quebec Specificity: the owner is responsible for registering with the Corporation de l'industrie
touristique du Québec (CITQ), displaying the establishment number on the listing, and collecting and
remitting the lodging tax.
Any failure to comply with these obligations may result in the modification, suspension, or removal
of the listing or account, without refund, and without liability on the part of the Platform.
7. Security Deposits and Relations with Guests
The Platform never intervenes in the collection or refund of payments
or security deposits. The owner is solely responsible for them.
8. Complaints, Suspension, and Removal
In the event of serious or repeated complaints, including failure to refund security deposits,
the Platform reserves the right to suspend or remove a listing or an account,
without refund.
9. Voluntary Removal and Termination
The owner may remove a listing or cancel a subscription at any time.
However, no refund shall be issued.
10. Non-transferability and Listing Limitations
- A listing or an account is non-transferable;
- A listing is intended to promote a single property only.
11. Chargebacks and Bank Disputes
The owner agrees not to dispute charges once the service has been rendered.
Any abusive chargeback may result in administrative fees and permanent account termination.
12. Stripe and Credit Card Payments (Optional)
The Platform offers owners the optional ability to register with Stripe in order to send payment
requests to guests and accept credit card payments.
Registration with Stripe is optional and is completed through a“Standard” Stripe account, established directly between the owner and Stripe.
All payments made by guests are processed by Stripe and are deposited directly into the owner’s Stripe account. The Platform does not act as a merchant, payment intermediary, trustee, or financial agent.
The Platform does not hold, control, or process any funds related to payments made between
owners and guests.
The owner is solely responsible for managing payments, refunds, disputes, chargebacks,
Stripe fees, and any communications or obligations with Stripe or financial institutions.
Under no circumstances shall the Platform be held liable for declined payments, processing delays,
payment disputes, or chargebacks arising from the use of Stripe.
13. Limitation of Liability
The Platform shall not be held liable for the actions of owners, guests, or potential buyers,
nor for the outcome of a sale or rental.
14. Amendments to the Terms
These terms may be amended at any time.
Continued use of the Platform constitutes acceptance of the updated terms.
15. Governing Law
These terms are governed by the applicable laws of the Province of Quebec.
